1. Identification and acceptance of the Terms
These Terms of Use (the "Terms") govern access to and use of the house-redesign.com website, its subdomains and associated materials (together, the "Site"), as well as the services offered by Hard Re-Design LLC (the "Company", "we" or "our"), including without limitation: construction, remodeling and roofing services, design and plans; equipment and machinery rental; site visits; quotes; appointment scheduling; and digital tools such as the artificial intelligence assistant ("AI") and the messaging channels (WhatsApp, Instagram and Facebook Messenger).
By accessing the Site, registering, requesting a quote, scheduling an appointment, sending us a message through any channel, contracting a service or using any of our tools, you state that you have read, understood and accepted these Terms in full, and that they constitute a binding agreement between you and the Company. If you disagree with any part of these Terms, you must refrain from using the Site and the Services.
To use most of our Services you must be of legal age under applicable law (18 years) and have the legal capacity to enter into contracts. If you use the Site or the Services on behalf of a company or organization, you state that you are authorized to accept these Terms on its behalf, and that entity will be responsible for compliance with these Terms.
The Company operates and manages the Site and its tools, and may subcontract or assign to third parties (independent contractors, providers, technical staff) the performance of the work and services, without this modifying the contractual relationship with the client.
2. User agreement and express consent
By accepting these Terms you confirm and expressly acknowledge that: (a) you have read and understood these Terms; (b) you agree to abide by them and by any policy referred to on the Site; (c) you consent to the processing of your personal data in accordance with the Data and Privacy section and our Privacy Policy; (d) you consent to receiving commercial communications, confirmations and notifications by WhatsApp, email, text messages (SMS) or telephone calls, in accordance with the Communications section; and (e) you understand that use of the Services, including the AI-assisted ones, creates an agreement between you and the Company only on the terms described here and in the corresponding quote or contracting documents.
The Site forms (quote, contact, booking, registration) include checkboxes for express consent; sending a message via WhatsApp, Instagram or Facebook to our official channels, or through the contact form, also constitutes consent for the Company to handle your request and communicate with you through that same channel.
Consent may be withdrawn at any time by notifying us through the channels indicated in the Contact section, without retroactive effect on services already provided or on processing required by law.
- I authorize Hard Re Design to contact me through the channels I used, including WhatsApp, to handle my request, quote or appointment.
- I authorize the processing of my personal data in accordance with the laws applicable in the United States and the Privacy Policy of the Site.
- I understand that conversations with the AI assistant may be stored and used to provide the service, improve quality and comply with legal obligations.
- I authorize the use of my data for invoicing, collections and performance of the contracted service.
If you do not check the consent boxes or do not accept these Terms, you will not be able to use those Services that require it.
3. Services of the Company
The Company provides construction, remodeling, roofing, exteriors, design and visualization, plans and blueprints services, as well as equipment and machinery rental, in accordance with its current catalogue published on the Site. The description of each service on the Site is informative and indicative, and the specifics of each job are agreed in the corresponding quote or work order.
In addition, the Company makes digital tools available: online quotes, appointment scheduling, an AI assistant through WhatsApp and other messaging channels, and content generated or assisted by AI. These tools are intended to facilitate and manage work; they do not replace the technical, legal or professional review that each project may require.
The Company may modify, suspend or discontinue services, features or tools of the Site at any time, with or without prior notice, when there are technical, operational, security or legal reasons.
4. Registration and user accounts
To access certain features you may create an account by providing truthful, complete and up-to-date information. You are solely responsible for the confidentiality of your access credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
The Company may suspend or close accounts that violate these Terms, that contain false or fraudulent information, or that represent a risk to the Company or third parties, without prejudice to the legal actions that may apply.
5. Communications and messaging channels
By providing your phone number, email address or messaging account, and by sending messages to our official channels, you accept and consent to receiving: (a) acknowledgements of receipt and of appointments; (b) responses to your requests; (c) notifications about the status of your services; and (d) commercial communications we consider relevant to you. You may opt out of commercial communications at any time through the Contact channels or by replying "STOP" where applicable; transactional communications (confirmations, appointments, invoices) cannot be refused while you maintain an active service relationship, for compliance and security reasons.
Communications sent through third-party public channels (WhatsApp, Instagram, Facebook Messenger) are additionally subject to the terms and conditions of each platform provider. The Company has no control over the availability, security or policies of those platforms.
6. AI assistant and automated scheduling
The Company may use artificial intelligence assistants to answer questions, propose services, show suggested time slots and facilitate scheduling through WhatsApp, Instagram or Facebook. The assistant acts as a facilitator: (a) it does not constitute professional, technical, legal or financial advice; (b) the availability it shows is indicative and may change; and (c) responses may contain errors.
An appointment is only considered confirmed when: (a) the Company's scheduling system records it and (b) you receive a confirmation through the channel used. If the assistant indicates that it scheduled an appointment, you must verify the final confirmation; the Company will confirm each appointment through the channel before considering it firm.
Conversations with the AI assistant may be stored and used to provide the service, train and improve the assistant's quality (pseudonymized where possible), resolve disputes and comply with legal obligations, in accordance with the Data and Privacy section.
You may request to speak with a human at any time (for example by replying "human" or "agent" on WhatsApp). While a conversation is handled by AI, the absence of comprehension or generation errors is not guaranteed; you must verify any information you receive before making decisions.
7. Quotes, estimates and work orders
Quotes and estimates issued by the Company (through the Site, WhatsApp, email or a site visit) are non-binding offers for the Company until accepted in writing by both parties. Acceptance is understood as: signature of the quote or work order, formal confirmation by email or messaging, or payment of the corresponding advance, as indicated in each document.
Quotes are valid for 30 calendar days from issue, unless expressly stated otherwise. Prices and deadlines may vary due to changes in materials, site conditions, exchange rates or the availability of crews and equipment, and will be confirmed at the time of actual contracting.
Any change in the scope of work (additions, variations or deletions) must be set out in writing in a change order accepted by both parties. Without a written change order, the Company is not obliged to perform work outside the quoted scope.
In construction and remodeling projects, the client is responsible for obtaining and managing permits, licenses, soil studies and approvals from homeowners associations (HOA) or condominiums that apply, unless expressly agreed otherwise in the quote. The Company will cooperate with the technical documentation reasonably required.
The client must guarantee free and safe access to the work site and to public utilities (water, electricity) under the agreed conditions. Delivery deadlines are estimates and may be affected by weather, approvals, material availability or force majeure; the Company will not be liable for delays beyond its control.
Labour work carries a limited warranty of 12 months from completion, covering execution defects attributable to the Company and its crews. The warranty does not cover: damage from misuse, inadequate maintenance, modifications made by third parties, extreme weather conditions, or parts and materials with their own manufacturer warranty.
8. Scheduling, cancellations and rescheduling
Appointments may be scheduled through the Site, WhatsApp or other channels. By scheduling, the client accepts the cancellation policies in this section.
Cancellations must be communicated at least 48 hours in advance to avoid charges. Failing to show up for an appointment (no-show) or cancelling with less than 48 hours' notice may generate a charge equivalent to the site visit or the scheduled work, as applicable and in accordance with what was informed at the time of scheduling.
Rescheduling is subject to availability and must be coordinated with the Company. Site visits or on-site quotes may have a cost, which will be informed before the appointment; that cost may be deducted from the project value if the service is contracted.
9. Equipment and machinery rental
Equipment rental is governed by the specific conditions of the rental contract signed or accepted online. The client undertakes to: (a) use the equipment only for the indicated purpose and by trained personnel; (b) keep the equipment in good condition during the rental; (c) return it at the agreed time and place; and (d) cover damage, loss or theft of the equipment during the rental period, except for natural wear.
The Company may require a refundable security deposit and verify the technical capability of the client or its operators. Late returns will accrue daily charges according to the current rate, and the Company may recover the equipment through the legal means available.
10. Prices and payment
Prices are stated in United States dollars (USD) unless the quote or order expressly states another currency, and include or exclude taxes (including applicable state and local taxes) as indicated. The client will pay the amounts according to the agreed payment terms (advances, milestones, balances), with an advance before work begins being common.
Payments may be made by bank transfer, card (through the indicated payment gateway) or other methods the Company enables. The Company may suspend work in the event of payment default and charge default interest in accordance with applicable law.
11. Acceptable conduct and prohibited use
When using the Site and the Services you agree not to: (a) carry out illegal or fraudulent activities; (b) impersonate persons or entities; (c) attempt to breach the security, systems, networks or data of the Company or third parties; (d) send malicious content, spam or unsolicited messaging; (e) scrape, copy or exploit the Site's content in an automated way without authorization; (f) use the Services for purposes other than those intended; or (g) harass, threaten or harm users, staff or providers.
Breach of this section entitles the Company to suspend or terminate your access without prior notice and to exercise the corresponding legal actions.
12. Intellectual property
Unless otherwise indicated, all contents of the Site and of our communications (texts, logos, trademarks, designs, images, photographs, renders, plans, videos, software, code and structure) are the property of the Company or its licensors and are protected by applicable intellectual property laws.
When contracting our design, visualization or plans services, the final paid deliverables become available for the client's use for the contracted project; the process, unapproved drafts and the copyright inherent to the creative work remain, unless otherwise agreed in writing, the property of the Company, which may display the project in its portfolio unless a confidentiality agreement exists.
By sending us content (photos, texts, references), you grant us a non-exclusive, worldwide, royalty-free licence to use it for the purpose of providing the service, including its storage and processing by the AI tools we use.
13. Personal data and privacy
The Company processes personal data in accordance with the federal laws of the United States of America and the laws of the State of Georgia, including its consumer protection and privacy laws, and other applicable data protection and privacy regulations. The Site's Privacy Policy is an integral part of these Terms and describes in detail the purposes, categories of data, legal bases, recipients, retention periods and the rights of data subjects.
Main purposes of processing: (a) managing and providing the services and quotes; (b) scheduling and confirming appointments; (c) answering inquiries and providing support through the channels you use; (d) invoicing and collections; (e) compliance with legal, accounting and tax obligations; (f) security and fraud prevention; (g) improvements and quality control, including improving the AI assistants on pseudonymized bases where possible; and (h) commercial communications, when you have given your consent.
The Company does not sell personal data. We may share data with third parties strictly necessary to provide the services, including: infrastructure and hosting providers, payment gateway, messaging platforms (including Meta Platforms, Inc. for WhatsApp/Instagram/Facebook), AI or analytics providers, legal and accounting advisors, and authorities when required by law. Those third parties are bound by confidentiality and security obligations.
Conversation data (WhatsApp, Instagram, Facebook, forms) is retained while the relationship with the client exists or while necessary to comply with legal obligations, and is then deleted or anonymized in accordance with our retention policies.
You have the right to access, rectify, cancel or update your data, as well as to object to processing and to request information about the use of your data, by writing to info@house-redesign.com. You may also lodge a complaint with the United States Federal Trade Commission (FTC) at ftc.gov/complaint and with the office of the Attorney General or the consumer protection agency of the corresponding state.
14. Links and third-party services
The Site and the Services may integrate with third-party platforms (for example, external authentication, WhatsApp/Instagram/Facebook by Meta, payment gateways, AI tools). Use of those platforms is governed by their own terms and privacy policies. The Company is not responsible for the practices, availability or security of those third parties or for their content, and we recommend that you review their policies.
15. Disclaimer of warranties
Except as provided by the limited labour warranty in section 7 and by applicable consumer protection legislation that cannot be waived, the Site, the digital tools and the services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement or result. The Company does not warrant that the Site or the AI assistants will operate uninterrupted or error-free.
Equipment and machinery are delivered in reasonably operational condition, and the details of their condition are documented in the rental contract or delivery record.
16. Limitation of liability
To the maximum extent permitted by applicable law, the Company's total liability to you for any claim arising out of or related to these Terms, the Site or the Services shall be limited to the amount actually paid by you to the Company for the services involved in the claim during the twelve (12) months preceding the date of the event giving rise to the claim.
In no event shall the Company be liable for indirect, incidental, special, punitive or consequential damages, nor for lost profits, loss of data, business interruption or reputational harm, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits the Company's liability to the extent applicable law does not allow it, including, where applicable, damages caused by wilful misconduct or gross negligence, personal injury due to the Company's negligence, or liabilities that cannot be legally excluded.
17. Indemnification
The client agrees to defend, indemnify and hold harmless the Company, its officers, staff, contractors and providers from any claim, proceeding, loss, damage and expense (including reasonable legal fees) arising from: (a) the client's use of the Site or the Services; (b) breach of these Terms; (c) the information or content supplied by the client; or (d) infringement of third-party rights. The Company may assume the defence on such terms as it deems appropriate, upon notice to the client.
18. Termination and suspension
The Company may terminate or suspend, in whole or in part, access to the Site or the Services, without liability, when: the client breaches these Terms; fraud, abuse or a security risk is detected; it is required by legal obligations; or for a reasonable business decision, with notice where feasible.
The client may stop using the Services at any time; payment obligations for services already provided, as well as the sections that by their nature must survive (7, 10, 12, 13, 15, 16, 17, 19 and 21), shall remain in force.
19. Changes to the Terms
The Company may modify these Terms at any time. Changes will be published on this page with a new update date and, where the changes are relevant to registered users, will be notified through the available contact channels. Continued use of the Site or the Services after publication of the changes constitutes acceptance of the modified version.
20. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the United States of America and the State of Georgia, without prejudice to the mandatory consumer protection rules of the client's state or country of residence when that client is a consumer and those rules apply.
The parties will seek to resolve any discrepancy in good faith through direct negotiation. Failing agreement, disputes shall be submitted to the jurisdiction of the state and federal courts of the State of Georgia, United States of America, waiving any other forum that may correspond to them, without prejudice to the consumer's non-waivable rights under applicable law.
21. General provisions
If any provision of these Terms is held void or unenforceable, the remaining provisions shall remain in full force and the invalid provision shall be construed in the sense closest to the original intent. Failure to exercise a right does not constitute a waiver of it.
These Terms constitute the entire agreement between the client and the Company regarding their subject matter and prevail over any prior communication. The Company may assign its rights and obligations in the context of a reorganization, merger or sale, notifying you where appropriate.
The Spanish version of these Terms prevails over any translation.
